Nasarawa State Secures Full Electricity Regulatory Autonomy from NERC

In line with the amended Constitution of the Federal Republic of Nigeria and the provisions of the Electricity Act (EA) 2023 which empower states to regulate electricity generation, transmission, and distribution within their jurisdictions; Nasarawa State, having fulfilled the requirements of the Act, has received the transfer of regulatory oversight of its electricity market from the Nigerian Electricity Regulatory Commission (NERC) to the Nasarawa State Electricity Regulatory Commission (NASERC), thereby granting it full autonomy over the electricity market within the state.

Having met the stipulated requirements of the Act, the Nigerian Electricity Regulatory Commission (NERC) has formally transferred regulatory oversight to the newly established Nasarawa State Electricity Regulatory Commission (NASERC). The transfer is set to take effect from August 4, 2025.

As part of the transition process, Abuja Electricity Distribution Plc (AEDC) the current Distribution Company serving Nasarawa State has been directed to incorporate a new subsidiary, AEDC SubCo, which will be responsible for intrastate electricity distribution. This subsidiary is expected to be incorporated within 60 days from the effective date and must obtain an operational license from NASERC. NERC has further directed that all regulatory and operational handover processes be completed by February 3, 2026.

With this development, Nasarawa becomes the 13th state to receive electricity regulatory autonomy from NERC. It is important to emphasize that this autonomy is not merely symbolic; it comes with a profound responsibility to improve the state’s electricity market, enhance power supply, and create a more investor friendly environment.

It is anticipated that Nasarawa State will embrace this new responsibility and work diligently to ensure a more reliable, efficient, and responsive electricity sector for its residents and businesses.
